Stretch Break Timer is a wellness app that helps you take regular stretch breaks throughout your workday. The App is designed with user privacy in mind:
- No user accounts required - The app works entirely without registration or login

- No health data collected - Despite being a stretch/wellness app, we do not collect HealthKit data or medical information
- No location tracking - We do not access or collect your location
- No advertising - The app contains no ads and no IDFA tracking
- Anonymous analytics only - Analytics data is not linked to your identity
2. Data We Collect
The app collects minimal data to provide and improve its functionality. All identifiers are anonymous and not linked to your personal identity.
2.1 Local Device Storage
- What: App settings, preferences, session history, streak data, reminder configurations
- Storage: Stored locally on your device only using iOS UserDefaults and Core Data
- Purpose: To remember your preferences, track your progress, and schedule reminders
- Your control: You can reset all data within the app settings or by deleting the app
2.2 Anonymous Identifiers
- User ID: Anonymous identifier for analytics and purchase management
- Device ID: Anonymous device identifier for analytics and crash reporting
- Purpose: Analytics, crash reporting, purchase verification
- Use: Analysis and App Functionality only (NOT for advertising or tracking)
- Linked to identity: NO - these IDs are not linked to your name, email, or personal information
- Tracking: NO - not used for cross-app tracking or advertising purposes
2.3 Purchase Data
- What: Purchase history, subscription status, transaction receipts
- Purpose: To verify Premium status and enable purchased features
- Use: Analysis and App Functionality only (NOT for advertising or tracking)
- Linked to identity: NO - purchases are managed via anonymous user IDs
- Tracking: NO - not used for cross-app tracking or advertising purposes
2.4 Usage Data - Product Interaction
- What: App launches, screen views, button taps, feature usage, session completions
- Purpose: To understand how users interact with the app and improve features
- Use: Analysis and App Functionality only (NOT for advertising or tracking)
- Linked to identity: NO - usage data is anonymous
- Tracking: NO - only tracks activity within our app, not across other apps or websites
2.5 Diagnostic Data
- Crash Data: Crash logs, stack traces, error messages to help us fix bugs
- Performance Data: App startup time, frame rates, memory usage to optimize performance
- Purpose: To minimize crashes, improve stability, and enhance app performance
- Use: Analysis and App Functionality only (NOT for advertising or tracking)
- Linked to identity: NO - diagnostic data is anonymous
- Tracking: NO - not used for cross-app tracking or advertising purposes
3. Third-Party Services
We use the following third-party services to provide and improve the App:
3.1 Firebase (Google LLC)
Services used: Firebase Analytics, Firebase Crashlytics, Firebase Performance Monitoring
- Data processed: Anonymous user IDs, device IDs, app usage events, crash logs, performance metrics
- Purpose: To understand app usage, fix crashes, and improve performance
- What Firebase receives: Anonymous identifiers, usage events, crash data, device information
- What Firebase does NOT receive: Your name, email, phone number, location, health data, or any personal information
- Data location: May be processed in the United States and other countries where Google operates

3.2 RevenueCat
- Service: We use RevenueCat to manage in-app purchases and subscriptions
- Data processed: Anonymous user ID, purchase transactions, subscription status
- Purpose: To verify your Premium status, manage subscriptions, and restore purchases across devices
- What RevenueCat receives: Anonymous app user ID, purchase receipts from Apple
- What RevenueCat does NOT receive: Your name, email, phone number, or any personal information
- Data location: May be processed in the United States

3.3 Apple App Store
- All payments are processed by Apple through the App Store
- We do not receive or store any payment information (credit card, bank details, etc.)

5. Data We Do NOT Collect
Stretch Break Timer is built on the principle of privacy-first design. We do not collect:
- Names, email addresses, phone numbers, or any contact information
- Location data (precise or approximate)
- Health or fitness data (no HealthKit integration)
- Photos, videos, or camera access
- Contacts or social media connections
- Microphone or audio recordings
- Browser history or search history
- Financial information (payment cards, bank accounts)
- Sensitive data (race, religion, sexual orientation, political opinions, etc.)
- IDFA (Identifier for Advertisers) or any advertising identifiers
- Data from other apps or websites you visit
- Any personally identifiable information
6. How We Use Your Data
The data we collect is used solely for:
- App Functionality: Managing reminders, tracking streaks, enabling Premium features, preventing fraud
- Analysis: Understanding user behavior, measuring feature effectiveness, improving app quality
- NOT for Advertising: We do not use your data for third-party advertising or developer marketing
- NOT for Tracking: We do not track you across apps or websites for advertising purposes
- NOT for Personalization: We do not personalize content based on user profiles
7. Data Security
- All local data is stored using Apple's secure frameworks (UserDefaults, Core Data)
- Network communications use HTTPS/TLS encryption
- We have no central servers that store your personal data
- Anonymous identifiers cannot be traced back to you
- The app works fully offline (except for purchases and optional analytics)
8. Data Retention and Deletion
- Local data: Retained on your device until you delete it within the app or uninstall the app
- Firebase data: Subject to Firebase's retention policies (typically 14-60 days for analytics, longer for crash reports)
- RevenueCat data: Subject to RevenueCat's retention policy (required for subscription management)
- Complete deletion: Uninstalling the app removes all locally stored data immediately

9. International Data Transfers
Firebase (Google) and RevenueCat may process data in the United States and other countries. These transfers are protected by:
- Standard Contractual Clauses (Art. 46(2)(c) GDPR)
- Google's and RevenueCat's data processing agreements
- Appropriate technical and organizational security measures
Your locally stored app data (settings, session history, streaks) never leaves your device and is not subject to international transfers.
10. Your Rights (GDPR)
If you are in the European Economic Area, you have the following rights:

- Erasure (Art. 17): Request deletion of your data

Since all identifiers are anonymous and not linked to your identity, we have limited ability to identify and delete specific user data from analytics systems. However, you can:
- Delete all local data by resetting the app or uninstalling it
- Disable analytics by adjusting iOS privacy settings

11. Children's Privacy
Stretch Break Timer is suitable for users of all ages. The app:
- Does not collect any personal information from children or adults
- Does not require account creation or registration
- Does not contain advertising
- Does not allow communication with other users
- Uses only anonymous identifiers that are not linked to identity
- Stores session history and preferences locally on the device only
Parents can use the app together with children without privacy concerns, as no personal or health data is collected.
12. California Privacy Rights (CCPA)
If you are a California resident, you have the right to:
- Know what personal information we collect (see Section 2)
- Request deletion of your personal information
- Opt-out of the sale of personal information (we do NOT sell your data)
- Non-discrimination for exercising your privacy rights

13. Do Not Track
We do not track users across apps or websites for advertising purposes. The app does not respond to "Do Not Track" signals because we do not engage in tracking as defined by DNT.
14. Changes to This Policy
We may update this privacy policy to reflect changes in our practices or legal requirements. The effective date at the top indicates when this policy was last revised. Significant changes will be communicated through the App Store update notes. Continued use of the app after changes constitutes acceptance of the updated policy.

By downloading, installing, or using Stretch Break Timer ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms and Apple's App Store Terms of Service.
2. Acceptable Use
You agree to use the App only for lawful purposes. You shall not:
- Use the App for any illegal or unauthorized purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use the App to harass, abuse, or harm others
- Redistribute, sell, or sublicense the App
- Use the App in any way that could damage, disable, or impair our services
3. In-App Purchases & Subscriptions
- The App offers optional Premium features available through in-app purchase or subscription
- All purchases are processed by Apple and subject to Apple's terms and conditions
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
- You can manage subscriptions and turn off auto-renewal in your iOS Settings → [Your Name] → Subscriptions
- Purchases are non-refundable except as required by applicable law or Apple's refund policies
- You can restore purchases on the same Apple ID at no additional cost
- Premium features remain active as long as your subscription is valid
4. Medical Disclaimer
IMPORTANT: Stretch Break Timer is a wellness app designed to remind you to take breaks and provide guided stretching exercises. It is NOT a medical device and should NOT be used as a substitute for professional medical advice, diagnosis, or treatment.
- Always consult a physician or qualified healthcare provider before starting any new exercise program
- Stop using the app immediately if you experience pain, dizziness, or discomfort during exercises
- The app's exercises are general recommendations and may not be suitable for everyone
- Users with existing medical conditions, injuries, or physical limitations should seek professional guidance
- We are not responsible for any injuries that may occur from using the app or following its exercises
- The app does not diagnose, treat, cure, or prevent any disease or medical condition
5. Intellectual Property
The App, including its design, graphics, text, animations, sounds, and code, is owned by Kevin Merz and protected by copyright and other intellectual property laws. The name "Stretch Break Timer" and associated branding are trademarks of Kevin Merz.
- You may not copy, modify, distribute, or create derivative works based on the App
- You may not use our trademarks without prior written permission
- Exercise descriptions and animations are proprietary content
6. User-Generated Content
Any data you create in the App (session history, custom routines, preferences) is stored locally on your device only. We do not collect, store, or have access to this content. You retain all rights to your locally stored data.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
- SUITABILITY OF EXERCISES FOR YOUR PHYSICAL CONDITION
- EFFECTIVENESS OF STRETCHING ROUTINES
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific health outcomes or results.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- KEVIN MERZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- THIS INCLUDES ANY PHYSICAL INJURIES OR HEALTH-RELATED DAMAGES RESULTING FROM USE OF THE APP
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS
- THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE)
9. Indemnification
You agree to indemnify, defend, and hold harmless Kevin Merz from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any injuries or damages resulting from following the App's exercises
- Any content you create or store using the App
10. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination:
- Your license to use the App terminates immediately
- You must cease all use of the App
- Active subscriptions may be canceled (subject to Apple's refund policies)
- Locally stored data remains on your device until you delete the app
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Soest, Germany.
For users in the European Union, you also have the right to bring proceedings in the courts of your country of residence.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kevin Merz regarding the App and supersede any prior agreements, whether written or oral.
14. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
15. Assignment
You may not assign or transfer these Terms or any rights granted hereunder. We may assign these Terms or any rights under them without your consent.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page or notification through the App. Significant changes will be communicated through the App Store update notes. Your continued use of the App after changes constitutes acceptance of the modified Terms.
